Calamine Bulldogges Puppy Contract

The buyer agrees to purchase the puppy identified as _____________________ from the litter out of the Dam___________________ and the sire ___________________ born on ______________ for the sum of $______________________and/or ________________________.

1. All puppies require $400 for a deposit. Deposits must be made in cash, U.S Postal money order or Paypal is accepted

1. Choice of puppy is determined on a first come (deposit received first) first to choose basis.

1. This puppy is sold ( ) with  ( ) without breeding rights. If without breeding rights, puppy must be spayed or neutered within the first four months after receipt. When proof of neuter/spay (copy of veterinarian statement identifying dog) is provided to the seller, the seller will supply registration papers. FAILURE TO COMPLY WILL RESULT IN BUYER RETURNING PUPPY TO SELL, AND BUYER WILL PAY ALL COSTS (SMALL CLAIMS COURT, TRANSPORTATION ETC.) INCURRED BY SELLER WHILE RECOVERING THE PUP.  Initials of buyer_______________

1. Deposits are NON_REFUNDABLE, if you decide you do not want the puppy, you forfeit the deposit.

1. All shipping costs are the buyer’s responsibility. This includes vet certificate(s), flight crate, and any other actual shipping costs.

1. Final payment (which includes all shipping costs) will be made in cash, U.S. postal money order, or Paypal.

1. In order to insure proper socialization, pups will not be released before they are eight weeks of age. If shipping/pick-up arrangements have not been effected by the time that the pups are 10 weeks old, buyer agrees to pay the sum of $ 35.00 per week boarding charge plus any other expenses incurred, until the pup is shipped. If puppy has not shipped by the end of the 16^th week the buyer forfeits any and all deposits.

1. Breeder reserves the right to refuse or cancel the sale of puppies to anyone, at any time, and for any reason for the welfare of the pup. The welfare of the puppy is the first concern of the breeder.

Guarantees

Seller guarantees animal to be in good physical condition for the first 72 hours after the time of delivery to the buyer. The buyer agrees to have the puppy examined by a veterinarian within 72 hours after delivery.

We guarantee against all genetic defects that come from our breeding program for a period of 2 years. If a genetic defect is found, we will exchange your puppy with another of equal value, subject to a veterinarians signed and dated statement of the puppy’s genetic condition and the cause of the defect or condition, subject to review of a veterinarian of the seller’s choice at the seller’s expense. The seller is not responsible for defects/conditions caused by buyers neglect, abuse, improper nutrition, mishandling, or any injuries to puppy caused by said conditions. Breeding or participation in extreme sports voids this guarantee.

Seller warrants that pups will have been wormed twice and are current on vaccinations as appropriate for the dog’s age

Seller will provide temporary registration for dogs purchased

Buyer Agrees

1. To use the kennel name “Calamine Bulldogges” as the prefix in the registered name of the dog and will not represent the dog as a product of his/her breeding.

1. In the event the dog is later sold or otherwise transferred from the possession of the buyer for any reason, the seller will have absolute right of first refusal to repurchase the dog for a sum not to exceed the original purchase price.

1. The dog will at all times be provided with proper health care, living conditions, nourishment and water.

1. The dog will not be kept on a chain for long periods of time.

1. The dog will not be engaged in fighting or any illegal activity.

1. Females will not be used in a breeding program prior to 18 months of age, or in the case of a male, one year of age.

1. Buyer agrees that the remedy for failure to comply with items 1-6 is forfeiture of the dog, to include all recovery costs incurred by the seller.

The buyer and seller agree that this is the full and complete agreement between the two parties for the sale of this dog/puppy. Any agreements made prior to this are considered incorporated herein and any modifications made to this agreement shall be made in writing, or such shall not be effective
